Social Security Fairness Act: Benefits You Never Filed For
If a government pension once wiped out your spousal or survivor benefit, that rule is gone. Social Security will not come find you.

What this program is, in plain English
The Social Security Fairness Act, signed in January 2025, repealed two rules called the Windfall Elimination Provision and the Government Pension Offset. Those rules cut or erased Social Security benefits for teachers, firefighters, police officers, postal and other public employees who had a pension from work where Social Security taxes were not withheld. Social Security has been adjusting people who already had a claim on file. The problem is everyone who never filed at all, because someone at the office told them years ago that the offset would leave them with nothing. Those people are not in the system, so nobody is looking for them. If that was you or your spouse, you have to file yourself. Benefits under this change are payable back to January 2024.
What you actually get
A monthly spousal or survivor benefit that was previously offset to zero, plus back pay to January 2024 for those found eligible.
Who qualifies
- You are 60 or older.

- Applies to anyone with a pension from non-covered public employment who is or was entitled to a Social Security spousal or survivor benefit and did not file because of GPO, or whose own benefit was reduced by WEP.
